FarmScout Terms of Service

FARM SCOUT LLC – TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the FarmScout™ mobile application, the website located at farmscout.ai, and the producer portal located at app.farmscoutapp.com (collectively, the "Service"), operated by Farm Scout LLC ("FarmScout," "we," "our," or "us").


By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.


1. Who We Are


FarmScout™ is a farm and agricultural discovery platform that helps consumers find farms, farm stands, farmers markets, nurseries, seafood markets, vineyards, orchards, apiaries, and other agricultural businesses and destinations.


Consumers access FarmScout through the FarmScout mobile application, which is currently available on iOS and may be offered on Android or other platforms in the future.


Producers access a separate web-based portal at app.farmscoutapp.com to claim or manage their listings and update inventory, products, events, and business information.


FarmScout displays business listings, inventory information, and event updates to help consumers discover what farms and other agricultural businesses may have available before visiting. FarmScout is a discovery guide and is not a marketplace, seller, payment processor, or party to transactions between consumers and listed businesses.


2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.


3. Accounts


Consumer Mobile App


The FarmScout consumer mobile application does not require users to create a FarmScout account, provide an email address, or establish a FarmScout password.


Access to the consumer application may be provided free of charge or may require an in-app subscription, depending on the access mode offered at the time. Purchasing a subscription through Apple or Google does not create a FarmScout consumer account. Subscription access is associated with the applicable Apple ID or Google Play account and is managed through that platform.


Producer Portal


Producer accounts are free and are accessed through the web-based portal at app.farmscoutapp.com. Producers may register to claim or manage a business listing and update inventory, products, events, and business information.


Producers are responsible for maintaining the confidentiality of their account credentials and are responsible for activity conducted through their accounts. Producers must notify FarmScout promptly at support@farmscout.ai if they believe their account has been accessed without authorization or otherwise compromised.



4. Access, Subscriptions, and Payments


FarmScout may offer free access, promotional access, trial access, paid subscription access, or a combination of these access methods. The access options available may change over time.


When paid subscriptions are offered, they are processed through Apple In-App Purchase on iOS and, if an Android subscription is offered, through Google Play Billing. By purchasing a subscription, you agree to the payment and subscription terms of the applicable platform.


For automatically renewing subscriptions:


- Payment is charged through your Apple ID or Google Play account at confirmation of purchase.

- The subscription automatically renews unless it is cancelled within the period required by Apple or Google before the end of the current subscription term.

- You may manage or cancel the subscription through your Apple ID or Google Play account settings.

- Deleting the FarmScout app does not automatically cancel a subscription.

- FarmScout does not directly process subscription payments and does not receive or store full payment card or banking information.

- Refund requests are governed by the refund policies of Apple or Google and generally must be submitted through the applicable platform.

- Subscription pricing may change prospectively in accordance with applicable law and the rules and notice requirements of Apple or Google.


FarmScout may temporarily provide access without requiring an active subscription. Free or promotional access does not guarantee that the same access will remain available indefinitely. Any future restriction of access or reactivation of a subscription requirement will apply prospectively and will be presented through the application or applicable app store.


5. Producer Listings

FarmScout compiles business listings from publicly available sources and producer submissions. Listings may include business name, address, phone number, website, operating hours, product categories, seasonality, and general descriptive information.

Inclusion of a listing does not imply endorsement, partnership, certification, or affiliation with Farm Scout LLC. FarmScout does not independently verify, and does not warrant the accuracy, completeness, or current status of, any listing information. Listings are provided as a discovery resource only. Users are encouraged to confirm hours, products, pricing, and any other operational details directly with the business before traveling to or transacting with that business.

If you are an authorized representative of a listed business and wish to update, correct, or request removal of your listing, contact us at privacy@farmscout.ai. We may require reasonable verification before processing changes.


5A. Inventory Availability and Events

FarmScout may display inventory information, product availability, and events for both claimed and unclaimed listings. For claimed listings, this information is provided by the producer ("Farmer Verified"). For unclaimed listings, FarmScout may add availability or event information it observes from publicly available sources — including a producer's public social media posts, information a producer or third party sends or tags to FarmScout by message, text, or email, public directories, and tourism sources. Such information is labeled with the date it was observed (for example, "Inventory Observed [date]"), is unverified, and may be inaccurate or out of date. Users must confirm directly with the business before visiting. Producers may claim their listing at any time to manage this information themselves, or request removal at privacy@farmscout.ai.


5B. Sponsored Content Within FarmScout


FarmScout may display paid sponsored listings, promotions, and events within the Service ("Sponsored Content"). Sponsored Content will be identified as sponsored or as an advertisement.


Sponsored Content may be selected based in part on approximate proximity to a user's current or searched location, such as whether a sponsoring business is located within a relevant distance of that area. Proximity calculations are approximate and are not guaranteed to be exact.


Advertisers pay FarmScout for placement within the Service. FarmScout does not provide advertisers with a consumer's identity, precise device location, search history, listing activity, analytics identifier, or other personal information.


Inclusion of Sponsored Content does not constitute an endorsement, warranty, partnership, certification, or recommendation by FarmScout. FarmScout is not responsible for an advertiser's products, services, events, availability, claims, pricing, conduct, or compliance with applicable law.


Any purchase, visit, communication, or other interaction between a user and an advertiser is solely between the user and the advertiser. FarmScout may accept, decline, suspend, modify, or remove Sponsored Content at its discretion. Advertisers may also be subject to a separate advertising agreement.


6. Producer Responsibilities and Content

Producers who claim and manage their listings are solely responsible for all content they submit, including inventory updates, event details, descriptions, and business information. By submitting content, producers represent and warrant that they:

- Own or have all necessary rights, licenses, and permissions to submit the content

- Will not submit content that is false, misleading, defamatory, unlawful, or infringing

- Will keep inventory and event information reasonably accurate and timely


FarmScout does not accept photo or logo uploads from producers or any third parties. No image or media files may be submitted through the Service.

FarmScout may remove, suppress, restrict, or modify any listing at its sole discretion, including for policy, legal, or quality reasons, without prior notice.


Certifications and Designations.

The Service may allow producers to self-designate certain business attributes, such as "Certified Organic" or "Veteran-Owned." These designations are self-reported attestations made solely by the producer. By selecting a designation, the producer represents and warrants that it is true, current, and supported by any required certification or documentation (for example, a current USDA organic certification). FarmScout displays these designations as provided by the producer and does not independently verify them. FarmScout may remove or decline to display any designation at its sole discretion.


7. License to Use the Service

Subject to your compliance with these Terms, FarmScout grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

You may not:

- Copy, scrape, crawl, or harvest listing data without our written permission;

- Use the Service to build a competing product or service;

- Reverse engineer, decompile, or attempt to extract source code from the app;

- Use automated tools to access or interact with the Service;

- Sell, sublicense, share, or transfer a producer account or other access rights to the Service.

- Upload photos, logos, images, or any media files through the Service or the producer portal at app.farmscoutapp.com. No image or media uploads are supported on either platform.


8. Location Information


The Service may request access to your device's location while you are actively using the mobile application. Location is used to show nearby listings, calculate approximate distance, sort results by proximity, and provide location-based functionality.


Location access is optional. If you deny or disable location permission, you may continue using the Service by entering a town, ZIP code, region, or other location manually.


FarmScout does not collect device location in the background or maintain a history of your movements.


FarmScout may use your current or searched location to display first-party Sponsored Content within the Service, as described in Section 5B. Advertisers do not receive your precise location or personal information from FarmScout.

8A. Usage Data and Service Analytics


FarmScout may collect and analyze information about how users interact with the Service in order to operate, test, secure, improve, and evaluate the platform.


This information may include actions such as:


- Performing a place, town, ZIP code, region, product, or event search;

- Viewing or selecting a search result;

- Viewing a farm, market, vineyard, nursery, seafood market, or other listing;

- Viewing inventory or event information;

- Selecting a region;

- Tapping a directions button;

- Tapping a listed business phone number;

- The general geographic areas users search; and

- The general destinations for which users request directions.


Consumer mobile-app usage data may be associated with a pseudonymous app-installation or analytics identifier. Because the consumer app does not require a FarmScout account, FarmScout does not associate this analytics identifier with a consumer's name, email address, phone number, Apple ID, or FarmScout consumer profile.


Producer-portal activity may be associated with the applicable producer account when necessary to authenticate the producer, operate the account, secure the portal, or provide listing-management functionality.


FarmScout may use usage and interaction data to:


- Improve search results, functionality, usability, and performance;

- Diagnose errors, crashes, and technical problems;

- Understand demand for products, categories, events, and locations;

- Measure engagement with listings and features;

- Evaluate whether users are finding relevant results;

- Generate aggregated or non-identifying insights that may be shared with producers regarding activity related to their listings; and

- Decide where first-party Sponsored Content may be useful within the Service.


FarmScout does not sell this usage data. FarmScout does not provide Meta with consumer search terms, listing views, directions requests, phone taps, precise location, or other post-install behavioral activity for targeted advertising or cross-app tracking.


FarmScout may use trusted analytics, infrastructure, search, hosting, security, and performance providers acting on its behalf, as further described in the Privacy Policy.


FarmScout may also send limited service-related notifications or requests for optional feedback. Participation in feedback requests is voluntary.


8B. Advertising and App-Install Attribution


FarmScout may advertise the FarmScout mobile application through third-party advertising platforms, including Facebook and Instagram services provided by Meta Platforms, Inc.


To measure whether an advertisement resulted in installation of the FarmScout iOS application, FarmScout may use the Meta Core SDK together with Apple's privacy-preserving SKAdNetwork or AdAttributionKit technologies.


The current implementation is limited to app-install attribution. It does not access the Apple advertising identifier, or IDFA; does not display an App Tracking Transparency permission prompt; does not include Facebook Login; and does not send Meta post-install search, listing, directions, phone, purchase, subscription, or other behavioral events.


FarmScout may receive aggregated or campaign-level reports indicating that installations may have resulted from particular advertising campaigns. These reports are used to evaluate the general effectiveness of FarmScout advertising.

9. Third-Party Services


The Service depends on or integrates with third-party platforms and service providers. These may include:


- Apple, for App Store distribution, in-app subscription processing, subscription status, and SKAdNetwork or AdAttributionKit attribution services;

- Google Maps and Apple Maps, for maps, location display, and directions;

- Firebase, a Google service, for app analytics, app-installation identifiers, performance measurement, and related technical services;

- Google Play, if an Android version or Android subscription is offered;

- Meta Platforms, Inc., through the Meta Core SDK, for privacy-preserving app-install attribution;

- GoDaddy, for website hosting, website operation, cookies, and website analytics; and

- Other infrastructure, database, hosting, search, notification, messaging, security, diagnostic, and performance providers used to operate the Service.


Third-party services operate under their own terms, policies, technical requirements, and privacy practices. Availability and functionality may depend on those third-party providers and may change or become unavailable without notice.


To the maximum extent permitted by law, FarmScout is not responsible for the accuracy, availability, security, conduct, content, or independent practices of third-party services.


Links or references to third-party websites, farms, markets, vineyards, businesses, products, or services do not constitute an endorsement, guarantee, or recommendation by FarmScout.


10. Intellectual Property

The FarmScout name, logo, app design, content, and all associated trademarks and trade dress are the property of Farm Scout LLC. All rights reserved. You may not use FarmScout's trademarks or branding without our prior written consent.

FarmScout™ is a trademark of Farm Scout LLC, with a pending federal trademark application filed January 27, 2026.


11. Accuracy Disclaimer

FarmScout does not guarantee the accuracy, completeness, or timeliness of any listing information, inventory data, event information, hours of operation, or other content displayed in the Service. Farm availability, hours, inventory, and events change frequently. Users should confirm all details directly with the farm or producer before visiting. FarmScout is not responsible for seller conduct, product quality, pricing, or any transaction between a user and a producer.

Listing information is compiled from publicly available sources, third-party directories, and content submitted by listed producers who have claimed their listings, as well as inventory and event information FarmScout observes from public sources for unclaimed listings. FarmScout does not independently verify, and does not warrant the accuracy, completeness, or current status of, any listing information regardless of source.

FarmScout does not verify the safety, quality, regulatory compliance, labeling, or production methods of any product offered by a listed business. Certain products — including but not limited to raw dairy, unpasteurized juices, wild-caught or aquaculture seafood, eggs, honey, plants, and direct-from-farm meats — may be subject to state or federal regulations that limit their sale, distribution, or intended use. You are solely responsible for understanding and complying with all applicable laws and for evaluating the suitability of any product for your own consumption or other use, including any health, allergy, or dietary considerations.

Businesses may close, relocate, change ownership, alter products, or change hours at any time without notice to FarmScout. Listings may include or reference information sourced from third parties (including the listed businesses themselves, public directories, social media, and tourism organizations). FarmScout does not control, endorse, or guarantee third-party content and is not responsible for it. FarmScout makes reasonable efforts to keep listings current but does not guarantee that information is immediately updated and is not obligated to update any specific listing on any schedule. Badges or indicators displayed in the Service, such as "Organic" or "Veteran-Owned," reflect self-reported attestations by the listed producer and are not verified or endorsed by FarmScout.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FARM SCOUT LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL FARMSCOUT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FARMSCOUT IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.


13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FARMSCOUT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.


14. Indemnification

You agree to defend, indemnify, and hold harmless Farm Scout LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any content you submit; or (d) your violation of any third-party rights.


15. Suspension, Termination, and Discontinuation


FarmScout may suspend, restrict, or terminate a producer account or a user's access to all or part of the Service if the user violates these Terms, misuses the Service, creates a legal or security risk, or engages in conduct that FarmScout reasonably determines may harm FarmScout, another user, a listed business, or a third party.


FarmScout may also modify, suspend, or discontinue all or part of the Service, including free-access features, subscription features, listings, geographic coverage, or producer-portal functionality, subject to applicable law and app-store requirements.


Consumer users who do not have a FarmScout account may stop using the Service at any time. Uninstalling the application does not automatically cancel an Apple or Google subscription. Any active subscription must be cancelled through the applicable Apple ID or Google Play account settings.


A producer may request closure of a producer account by contacting support@farmscout.ai. Account closure does not require FarmScout to remove publicly available business-listing information, although an authorized business representative may request correction or removal as provided in Section 5.


Upon suspension or termination, any license granted under these Terms ends immediately. Sections that by their nature should survive termination, including Sections 5, 5A, 5B, 6, 7, 10, 11, 12, 13, 14, 16, and 18, will survive.


16. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.


17. Changes to These Terms

FarmScout may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.


18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FarmScout regarding your use of the Service and supersede all prior agreements and understandings.
