These Terms of Service ("Terms") govern your use of the FarmScout™ mobile application and website located at farmscout.ai (collectively, the "Service"), operated by Farm Scout LLC ("FarmScout," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

FarmScout™ is a local farm discovery platform that connects consumers with farms, farm stands, nurseries, seafood markets, vineyards, and independent agricultural sellers. Consumers access FarmScout through the iOS and Android mobile apps. Producers access a separate free web-based portal at app.farmscoutapp.com to manage their listings and update real-time inventory. FarmScout displays farm listings and inventory updates to help people discover what local producers have available before they visit.

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

Consumer accounts require a valid email address and an active paid subscription to access full directory features on the iOS and Android apps.

Producer (farm) accounts are free and are accessed through the web-based portal at app.farmscoutapp.com. Producers may register to claim or manage their listing and update real-time inventory through the portal.

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@farmscout.ai if you believe your account has been compromised.

FarmScout offers paid consumer subscriptions available through Apple In-App Purchase (iOS) and Google Play Billing (Android). By subscribing, you agree to the applicable platform's payment terms.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You may manage or cancel your subscription through your Apple ID or Google Play account settings.
• FarmScout does not process payments directly and does not store payment card information.
• Refunds, if any, are governed by Apple's or Google's refund policies, not FarmScout's.
• FarmScout reserves the right to change subscription pricing with reasonable notice.

FarmScout compiles business listings from publicly available sources and producer submissions. Listings may include business name, address, phone number, website, operating hours, and general descriptive information.

Inclusion of a listing does not imply endorsement, partnership, or affiliation with FarmScout LLC. FarmScout does not independently verify all listing information and encourages users to confirm details directly with the business.

If you are an authorized representative of a listed business and wish to update, correct, or request removal of your listing, contact us at privacy@farmscout.ai. We may require reasonable verification before processing changes.

Producers who claim and manage their listings are solely responsible for all content they submit, including inventory updates, descriptions, and business information. By submitting content, producers represent and warrant that they:

• Own or have all necessary rights, licenses, and permissions to submit the content
• Will not submit content that is false, misleading, defamatory, unlawful, or infringing
• Will keep inventory information reasonably accurate and timely

FarmScout does not accept photo or logo uploads from producers or any third parties. No image or media files may be submitted through the Service.

FarmScout may remove, suppress, restrict, or modify any listing at its sole discretion, including for policy, legal, or quality reasons, without prior notice.

Subject to your compliance with these Terms, FarmScout grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

You may not:

• Copy, scrape, crawl, or harvest listing data without our written permission;
• Use the Service to build a competing product or service;
• Reverse engineer, decompile, or attempt to extract source code from the app;
• Use automated tools to access or interact with the Service;
• Sell, sublicense, or transfer your account or access rights.
• Upload photos, logos, images, or any media files through the Service or the producer portal at app.farmscoutapp.com. No image or media uploads are supported on either platform.

The Service requests access to your device's location while you are actively using the app in order to show nearby farms and sort results by proximity. Location access is optional. You may deny location permission and use the Service with manual region selection. FarmScout does not collect location data in the background. See our Privacy Policy for full details.

The Service integrates with third-party services including Google Maps and Apple Maps for direction functionality. These services operate under their own terms and privacy policies. FarmScout is not responsible for the accuracy, availability, or conduct of third-party services.

Links or references to third-party websites, farms, or businesses do not constitute an endorsement by FarmScout.

The FarmScout name, logo, app design, content, and all associated trademarks and trade dress are the property of Farm Scout LLC. All rights reserved. You may not use FarmScout's trademarks or branding without our prior written consent.

FarmScout™ is a trademark of Farm Scout LLC, with a pending federal trademark application filed January 27, 2026.

FarmScout does not guarantee the accuracy, completeness, or timeliness of any listing information, inventory data, hours of operation, or other content displayed in the Service. Farm availability, hours, and inventory change frequently. Users should confirm all details directly with the farm or producer before visiting.

FarmScout is not responsible for seller conduct, product quality, pricing, or any transaction between a user and a producer.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FARM SCOUT LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL FARMSCOUT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FARMSCOUT IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FARMSCOUT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

You agree to defend, indemnify, and hold harmless Farm Scout LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any content you submit; or (d) your violation of any third-party rights.

FarmScout may suspend or terminate your account and access to the Service at any time, with or without cause or notice, at our sole discretion. You may terminate your account at any time by contacting us at support@farmscout.ai.

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including Sections 7, 10, 12, 13, 14, 16, and 17) shall survive.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.

FarmScout may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FarmScout regarding your use of the Service and supersede all prior agreements and understandings.
